Georgia Drunk Driving

Driving Under the Influence of drugs or alcohol (DUI) and Driving While Impaired (DWI) are grim criminal drunk driving offenses in the State of Georgia. This may be your initial contact with the criminal justice system and now you have been arrested. When you are detained for an alcohol related offense some things can happen to you; the most stern is you can face a year or more in jail depending on the status of your stop. Also, you can lose your licence to drive for an extended time despite whether you are found in the wrong of the basic alcohol charge or drunk driving in Court. It is key that Georgia drivers are familiar with their legal rights in this complex state of affairs so that they will know how to successfully cooperate with the police.

In Georgia, once you are stopped for suspicion of DUI/DW or drunk drivingI, you have firm legal rights to defend your freedom but responsibilities also attach. For example, the officer will try to give you a number of field sobriety tests including a preliminary breath test. While you are under no legal duty to do any of these tests, many drivers still opt to try them. The dilemma with field sobriety tests is that they are distant tests, mostly done on the side of the road, at night and in the dark while the driver is tense and apprehensive. It is doubtful these test could be performed sufficiently under perfect rules, it is doubtful they can be performed under actual rules. When drivers try theses tests the police take many notes which are afterwards used in Court help convict the driver.

An informed Georgia Driver should know there is no legal requirement to take these DUI/DWI tests and generally the results are only used against the driver. In addition, the preliminary breath test offered on the street is also not legally needed and the decision to refrain from taking the test carries no negative consequences. Yet, for those that choose to engage these tests, the police use this evidence along with other indicators such as alcohol on the breath, blood shot eyes and slurred speech to support their case against the driver in Court.

If you or someone you know has been arrested for an alcohol offense or drunk driving, you must look for intelligent and aggressive legal representation. You have legal rights which must be exercised on a judicious basis or you may lose them.

Our attorneys have been effectively defending DUI and DWI cases for over a decade.
